U. S. Circuit Court Judge Shackelford Miller Jr., who served on the Court of Appeals for the Sixth Circuit, Cincinnati, from 1945 until his retirement last November 4, died Wednesday in Louisville, which was his home. He was 73.
The Appeals Court, of which Judge Miller became a esnior [sic] judge at his retirement, handles cases in the states of Ohio, Kentucky, Tennessee and Michigan.
A native of Louisville, Judge Miller came from a distinguished family of attorneys and political leaders. He had been a member of the Federal Judiciary since 1939, when he was appointed a district judge in Louisville.
His father, Shackelford Miller Sr., was a former chief justice of the Kentucky Court of Appeals and his brother, Neville Miller, now a Washington, D. C., attorney, was mayor of Louisville at the time of the 1937 flood.
When Judge Miller received his first Federal appointment in 1939, it was following his successful management of the re-election campaign of the late Sen. Alben W. Barkley in the previous year.
He was graduated from Princeton University, and received his law degree at the Harvard Law School in 1917. The following August he enlisted in the First Officers' Training School at Ft. Meyers, Virginia, and served overseas in World War I. He won promotion to captain in the 325th Field Artillery.
In addition to his brother, Judge Miller leaves a daughter, Mrs. Margaret H. Martin, Louisville.
