Notes for Ephraim Garthright III



WFT 5 # 1179 spelled his first name Ephrain. WFT 5 # 1179 and WFT 5 # 1346 had him as "Jr." rather than "III" because they didn't have the additional Ephraim in the tree. Carolyn Gathright and Craig Gathright have him born about 1730, while the two WFT trees have him born about 1710.

Several sources give his death date as 26 May 1789, but the will below is clearly for this family, and it is dated 1807. Note that his last name is spelled Garthright in the will transcription, but many sources (including Carolyn and Craig Gathright) spell it Gathright.

In the name of God amen, I, Ephraim Garthright of Henrico County, being in a low & low, state of health, do make and ordain this my last Will and Testament in manner and form following; Item, I lend unto my beloved wife the plantation, whereon I now live, together with all the crop of corn, wheat, oat @meat@ and four Negroes, Trim, Biddy, Lucy and Lewis, also 2 yoke of oxen the ox cart and another Negro named Jacob. Item, I give and bequeath unto my son Tarpley, the tract of land I purchased of Callom Farris also the tract I purchased of Warrinner, lying on the other side of the swamp; Item, I give and bequeath unto my daughter Susan a Negro boy named Elisha to her, her heirs. Item, I give and bequeath unto my daughter Elizabeth a Negro boy named Iam to her, her heirs forever.. Item, I give and bequeath unto my daughter Sally one Negro boy named Bob, one cow and calf to her , her heirs forever. After the death of my wife, it is my will that my son Anderson should have and hold all my lands hereby devised to my said wife, to him, his heirs forever, also a Negro boy named Arthur and one feather bed and furtic?. Item ,I give and bequeath unto my daughter, Nancy one feather bed, and furniture and one Negro girl named Phillis. Item, I give and bequeath unto my daughter Fanny one Negro girl Rhody and one feather bed and furniture complete. Item, I give and bequeath unto my daughter Polly one Negro girl named Jenny and one feather bed and furniture. Item, I give and Bequeath unto my son Tarpley a Negro girl named Dildy and her increase to him ,his heirs forever. It is further my will and desire that my daughters Fanny and Polly should have and maintain free right and title to my dwelling house and plantation during their single lives and all the rest and residue of my estate, I wish to be sold at the discretion of my executors out of which my just debts are first to be paid and the balance to be equally divided between my wife and children. Finally, I constitute and appoint my brother Anselmn Garthright and my friend and nephew Sam C Garthright executors to this my last Will and Testament given under my hand, seal, this twentieth day of February one thousand eight hundred and seven.

At monthly court, continued, and held for Henrico County at the Courthouse on Tuesday the seventh of April 1807. This Last Will and Testament of Ephraim Garthright dec'd. was proved by the oaths of John Goode and Littlebury Royster, two of the witnesses, thereto and ordered to be Recorded and on the motion of Anselmn Garthright one of the executors therein named who made oath thereto according to Law.
